They have 10 business days. Saturday does not count.
The Texas HOA Records & Financials Kit is a set of fill-in letters under § 209.005. You elect inspect or copies in the same request — the statute requires that. Certified mail to the address on the recorded management certificate. Instant PDF. Type, print, send tonight.
What you get
Sit with the books first
Elect inspection. They must send dates during business hours. You mark what to copy at the table.
Named list, mailed to you
Elect copies. Checkbox list so they cannot call the request “vague.”
Budget, reserves, banks
Adopted budgets, YTD P&L, reserve study or cash, association bank statements, audit — not the neighbor’s account.
Only your lot
Your written consent under § 209.005(l). Assessments vs fines vs fees, and how they applied payments.
Minutes and contracts
Open-session minutes and agendas. Management agreement and year-plus vendor contracts — not privileged legal advice.
Fine schedule + copy fees
Recorded fine policy and records-production policy. If they never recorded a copy-fee policy, they cannot charge you for copies.
What directors saw about YOU
Board-book pages, inspection photos, manager memos on your lot — plus the open-session vote § 209.0051 requires after they come back out.
If they ignore you
10-business-day follow-up, then the statutory notice before justice court, then how to file in JP court if you actually go that far.
Also included: how to send (management certificate, certified mail, what you may not ask for), and a fictional Fort Worth filled sample on each letter so you are not staring at empty brackets.
A look at the inspect letter
ELECTION. I elect to INSPECT the books and records identified below before obtaining copies. § 209.005(e)(1). I do not, by this letter, elect to have copies forwarded in lieu of inspection.
Please send written notice, on or before the 10th business day after you receive this request, of dates during normal business hours when I may inspect the requested books and records.
Who this is for
- You live in a Texas single-family or townhome HOA (Chapter 209). Not a condominium — condos are mostly Chapter 82.
- You want the budget, the reserves, your ledger, the recorded fine policy, or the packet from a closed session about your lot.
- You are willing to mail certified to the address on the management certificate, not a Facebook message to the board.
Who this is not for
- Condo owners using this as if Chapter 209 applied.
- Anyone asking for the neighbor’s delinquency list or another owner’s file.
- Anyone who already has a foreclosure notice or lawsuit — that is a lawyer’s file, not a $24 PDF.
- Anyone who wants a guarantee the board will produce everything tomorrow. The letters start the statutory clock. They do not hold the keys.
How it works
- Checkout on Payhip. The PDF downloads immediately.
- Pick one election: A1 (inspect) or A2–A8 (copies). Do not mix elections in one envelope unless you clearly elect inspect first.
- Typical first envelope: A7 + A4 (policies + your ledger). Add A3 if the fight is money. Add A8 if they already closed the door on your lot.
- Email a PDF the same day, then certified mail, return receipt, to the recorded management-certificate address. Keep the green card. Calendar 10 business days from the day they received it.

Questions
- Is this legal advice?
- No. It is a set of templates and a plain-English map of § 209.005. Your declaration still controls. We are not your lawyer.
- Inspect or copies — which one?
- The statute makes you elect in the same letter. Inspect first (A1) when you do not know what exists. Copies (A2–A8) when you can name the files. After an inspection you send a copies letter for only what you marked.
- Can they charge me for copies?
- Only if a records-production policy is recorded as a dedicatory instrument, and the amounts cannot exceed the state schedule. That is why A7 is in the kit. No recorded policy, no copy charge.
- They went into executive session about my lot. Is that secret?
- Closed session can protect other people and privileged legal advice. It does not hide your inspection photos and board-book pages once you consent in writing. That is letter A8. They still have to come back to open session to vote a fine.
- What if they never answer?
- A11-A is the follow-up after 10 business days. A11-B is the required notice before justice court. A12 is how JP court works if you actually file. Filing is a lawsuit; if they win they can recover their fees. Read A12 before you mail A11-B.
