They sent a lump sum. Make them itemize it — and stop reporting a debt you do not owe them.

The Texas HOA Collections, Dunning & Credit Kit is fill-in letters for the bill, the collector, and the credit file. § 209.0063 (what gets paid first), § 209.0064 (45 days before collector fees), § 209.0065 (do not report a pending dispute), FDCPA validation, overshadowing, and Texas Finance Code § 392.202. Two different files: you may owe the association. You usually do not have an account with the management company. If Experian shows their name as your creditor, that tradeline is the wrong account — even if a quarterly assessment number looks familiar. Inaccuracy is not only the dollar amount: status, lateness, dates, and “whose account” all count.

What you get

C1 · C2

Itemize / already paid

Break assessments vs fines vs attorney vs collector. Dispute a payment they missed or the wrong lot.

C3

Payment plan

§ 209.0062 — generally at least three months. You can dispute fines and still plan the assessments.

C4 · C5

Fees too early

Collector fees without a certified 45-day notice. Attorney’s fees before a hearing ends — and a demand for invoices.

C6 · C6b · C6c

The collector

FDCPA validation. Overshadowing (“pay in 10 days” inside the 30-day window). Texas Finance Code 392: cease collection and investigate.

C7 · C7b

Punch one

C7 to the HOA (Texas: pending dispute, do not report). C7b to whoever is on the credit report — often the manager — FCRA direct dispute of every field.

C8 · C8b

Punch two

C8 to Equifax, Experian, TransUnion after the green cards. C8b if they keep reporting a false late, wrong status, or the manager as your creditor.

C9 · C10

Calls and payoff

Writing only — this does not stop a foreclosure. Payoff / refinance itemization with disputed lines listed separately.

Guide

Tradeline fields

Not just the balance: late-that-wasn’t-late, payment grid, date of first delinquency, “owed to the manager.”

Certified-mail send list and fictional Fort Worth samples on each letter. First envelope for most people: C1 (and your ledger from the Records kit if you do not have one).

A look at the itemize letter

Excerpt · C1 · you fill the bracketed lines

I dispute that amount until it is itemized.

Please send a written breakdown … grouped as: (1) delinquent assessments, (2) current assessments, (3) late fees and interest, (4) fines, (5) attorney’s fees, (6) third-party collection fees, (7) any other charge.

Until I have that itemization I dispute the lump-sum figure. Please do not report this account to a credit reporting service while this dispute is pending. § 209.0065(a).

Who this is for

  • Texas single-family or townhome HOA (Chapter 209). Not a condominium.
  • You got a “balance due $____” with no breakdown, a collector letter, or a tradeline in the management company’s name.
  • You want paper: itemization, plan, validation, and a real dispute on every field they furnished — not a Facebook argument.

Who this is not for

  • Condo owners using Chapter 209 as if it applied.
  • Anyone with a foreclosure notice, sale date, or lawsuit — that is a lawyer, not a $29 PDF.
  • Anyone who wants a guaranteed bureau wipe. A false late should come off that field. A manager’s “your account with us” line can be a not-my-account dispute as to them. A lawful assessment, correctly reported, may stay.

How it works

  1. Payhip checkout. Instant PDF.
  2. Start with C1. Add C3 if you need time, C6/C6b/C6c if a collector wrote, C7+C7b if they report.
  3. Email a PDF the same day; certified mail to the management certificate (HOA) and to the address on the collector’s letter. Keep every green card — that is the one-two punch.
  4. C8 to the bureaus only after those receipts are back. C8b only if the new report still shows the false field.

Questions

Is this legal advice?
No. Templates and statutes. Not a law firm and not a credit-repair company.
The management company is on my credit report. Is that “not my account”?
You do not have a consumer account with the manager. Assessments, if owed, are owed to the association. That tradeline can be disputed as the wrong creditor. That is not the same as “I don’t owe the HOA.” Letter C7b has that box.
They reported a late that was not late, but the dues amount is right.
That is still an inaccurate item — status, lateness, dates, history. Dispute those fields. Correction of the late mark is the usual result, not automatic deletion of the whole HOA account.
What is overshadowing?
A collector’s 30-day validation notice plus “pay in 10 days or we report you” on the same page. C6b. FDCPA § 1692g(b).
Disclaimer. Personal, educational use only. Not legal advice, not credit-repair, not a guarantee of deletion or of any bureau or board outcome. Chapter 209 applies to most Texas residential subdivisions with mandatory assessments, not to condominiums. Confirm current Texas Property Code, Finance Code Chapter 392, and the FDCPA, and your dedicatory instruments, before you rely on a letter. If you are served with a lawsuit or a foreclosure packet, stop and consult a licensed Texas attorney.
